1. Mortgage Loan Products and Services; Authorization to Obtain Your Credit Report
The Momentum Mortgage Website is an online platform where you can learn about, apply for, and be connected with various mortgage loan products, including home purchase loans, refinance loans, home equity loans, and other mortgage-backed financing options (“Mortgage Loan Products”).
If you submit a request for a Mortgage Loan Product, you understand and agree that:
- We may collect personal information you provide to us (“Self-Reported Information”), such as your name, date of birth, address, phone number, Social Security number, income, and other financial details.
- By submitting your request, you are providing “written instructions” under the Fair Credit Reporting Act (FCRA) authorizing Momentum Mortgage and its affiliates to use your information to obtain your credit report and credit score for the purpose of evaluating your eligibility for a Mortgage Loan Product.
- We may share your Self-Reported Information with our network of lenders, banks, mortgage brokers, and other mortgage professionals (“Lender Partners”) to process your request.
Momentum Mortgage does not make loan or credit decisions for any Lender Partner and is not a party to any agreement you may enter into with them. We do not endorse any particular loan product or Lender Partner. Requirements for any specific product are determined solely by the Lender Partner.
2. Other Products and Services
If you request a product or service other than a mortgage loan — such as insurance, credit-related services, or other financial products — you understand and agree that Momentum Mortgage may share your information with third-party service providers (“Service Partners”) to process and fulfill your request.
Service Partners may contact you by telephone (including via an autodialer), SMS/MMS, email, or postal mail using the contact information you provided, even if you are on a federal or state Do Not Call registry. If you wish to stop communications from a Service Partner, you must contact that Service Partner directly.
3. Consent to Communications
By submitting your information through the Service, you consent to be contacted by Momentum Mortgage, our Lender Partners, and Service Partners by phone (including via an autodialer), SMS/MMS text message, email, and/or postal mail using the contact information you provide, even if you are on a federal or state Do Not Call registry.
You may withdraw your consent to receive communications from Momentum Mortgage at any time by contacting us directly. To stop communications from a Lender Partner or Service Partner, you must contact them directly.
4. Electronic Communications & E-Sign Consent
You agree that all agreements, disclosures, notices, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
- Scope of Consent: This consent applies to all interactions between you and Momentum Mortgage, including applications, disclosures, and notices related to your use of the Service.
- Hardware/Software Requirements: You will need internet access, an email account, and a device capable of viewing and printing documents (most modern browsers meet these requirements).
- Mobile Devices: If accessing our site on a mobile device, you must have the ability to view, save, and print documents.
- Withdrawing Consent: You may withdraw your consent to electronic communications by emailing us at compliance@momentummortgagegroup.com. If you withdraw consent, certain services may be unavailable.
5. Disclosure of Your Information
You acknowledge, consent, and agree that Momentum Mortgage may access, preserve, and disclose information we collect about you if required to do so by law or if we believe in good faith that such access, preservation, or disclosure is reasonably necessary to:
- 1. Comply with legal process or government requests.
- 2. Enforce this Agreement.
- 3. Respond to claims that any content violates the rights of others.
- 4. Respond to your requests for customer service.
- 5. Protect the rights, property, or safety of Momentum Mortgage, our users, or the public.
6. SAFE Act & NMLS ID Display
All mortgage loan originators affiliated with Momentum Mortgage Group, LLC, will prominently display their NMLS Unique Identifier on our website, marketing materials, email signatures, and any advertising communications to ensure transparency and consumer access to their licensing information.
7. Regulation Z / TILA Compliance
All mortgage products featured through our Service comply with the Truth in Lending Act (TILA) and Regulation Z, including clear, accurate presentation of Annual Percentage Rate (APR), finance charges, terms, and other disclosures in standardized formats.
8. RESPA Compliance
Momentum Mortgage Group, LLC, adheres to the Real Estate Settlement Procedures Act (RESPA). We provide required settlement disclosures and ensure that any referral fees or relationships with settlement service providers are fully disclosed and lawful.
9. Nondiscrimination
Momentum Mortgage Group complies with the Equal Credit Opportunity Act (ECOA). We do not discriminate against applicants based on race, color, religion, national origin, sex, marital status, age, public assistance status, or any other protected characteristic.
10. Privacy & Information Security (GLBA)
In accordance with the Gramm–Leach–Bliley Act (GLBA), we maintain a written information security program to safeguard nonpublic personal information. We provide privacy notices at the initiation of our client relationship and honor opt-out requests regarding disclosure of your information to unaffiliated third parties.
11. Advertising Accuracy
All advertised loan terms or promotions on our platform reflect actual, available offerings. Momentum Mortgage Group does not advertise terms that are unavailable or misleading, in compliance with Regulation Z (§1026.24) and related advertising rules.
12. Arbitration Agreement
You agree that any disputes, claims, or controversies between you and Momentum Mortgage (including affiliates, subsidiaries, and related entities) arising out of or relating to the Service or this Agreement shall be resolved exclusively through final and binding arbitration under the Federal Arbitration Act (FAA).
- Arbitration shall be conducted by a single arbitrator in Loudoun County, Virginia, unless otherwise required by law.
- You and Momentum Mortgage waive any right to a jury trial.
- You and Momentum Mortgage agree not to bring or participate in class actions, consolidated actions, or representative proceedings in arbitration.
13. Eligibility and Acceptable Use
You certify that:
- You are at least 18 years of age.
- All information you provide is accurate and complete.
- You will not use the Service for any unlawful purpose or submit any false or misleading information.
Prohibited activities include, but are not limited to:
- Uploading viruses or malicious code.
- Attempting to gain unauthorized access to our systems.
- Impersonating another person or misrepresenting your affiliation.
- Using automated tools to extract data without permission.
14. Intellectual Property Rights
All content on the Momentum Mortgage Website, including text, graphics, logos, and software, is owned by or licensed to Momentum Mortgage and is protected by copyright, trademark, and other laws. You may not copy, distribute, or create derivative works without our prior written consent.
15. Modification to Service
We reserve the right, at any time and without notice, to modify, suspend, or discontinue any part of the Service. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
16. Indemnification
You agree to indemnify and hold harmless Momentum Mortgage, its officers, employees, affiliates, and agents from any claims, damages, or expenses (including attorney’s fees) arising from your use of the Service or violation of this Agreement.
17. No Warranty & Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. Momentum Mortgage is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
18. Termination
We may suspend or terminate your access to the Service at any time for violations of this Agreement or other reasons at our sole discretion.
19. Governing Law & Venue
This Agreement shall be governed by the laws of the Commonwealth of Virginia, without regard to its conflicts of law principles. Any arbitration or legal proceedings shall take place in Loudoun County, Virginia.
20. Statute of Limitations
Regardless of any statute or law to the contrary, any claim or cause of action arising from or relating to your use of the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred.

The following sections survive termination of this Agreement or your refusal to continue using the Service:
